The Escrow Gold Gavel Award
The most scandalous confession of the day, as determined by Judge Reginald Escrow III.
CONFESSION #0624 — LOWBALL OFFER
Her daughter started asking questions. That's how the whole thing fell apart. We're at the table, seller's ready to sign, and the daughter goes wait, what's the actual number here. Buyer offered 340 on a house listed at 425. I'm talking 85 thousand under asking. The seller, she's 78, she's tired, she just wants to move closer to her son in Tampa. She was going to take it. She told me on the phone she didn't want to negotiate, didn't want the stress. The daughter pulls out her phone, shows her mom three comps from the last six months. Same street. 410, 418, 395. The mom looks at me like I betrayed her. I didn't. I just didn't push back when I should have. We countered at 405. Buyers walked. The daughter doesn't return my calls now.

GUILTY OF ELDER-ADJACENT FIDUCIARY NEGLIGENCE AND WILLFUL FAILURE TO ADVOCATE IN THE FIRST DEGREE
The Court has reviewed this confession and finds itself PHYSICALLY ILL. You had a 78-year-old woman, exhausted, vulnerable, ready to hand over EIGHTY-FIVE THOUSAND DOLLARS of her equity to some lowballing opportunist, and your professional contribution was to sit there like a decorative throw pillow at an open house. The daughter did YOUR job with a PHONE, counsel. A PHONE. Reginald once watched his own mother almost buy a timeshare in Branson because no one intervened, and that memory haunts me to this day, so do NOT come into this courtroom pretending passivity is not a choice. You knew the comps. You knew the market. You knew that woman trusted you to be her advocate, not her witness. The fact that she looked at you like you betrayed her is because YOU DID, and the fact that the daughter won't return your calls is because she is CORRECT. The Court hereby orders you to tape those three comps to your bathroom mirror and look at them every morning until you remember what fiduciary duty means. Reginald must now go lie down because this one genuinely upset him.

The Certificate of Distinguished Incompetence
A noteworthy display of professional misfortune.
CONFESSION #0625 — OTHER AGENT WAS THE PROBLEM
The seller changed her mind. Three days before closing, she wants to stay. Her agent calls me and says, quote, "She's having second thoughts about the memories." My buyers have already given notice on their apartment. They have a moving truck booked. I say we need to talk about the contract. Her agent says "Contracts are just paper, you know? People matter more than paper." I said the earnest money matters. The inspection costs matter. The appraisal my buyers paid for matters. She says "Can't your people just find another house?" There's like 12 houses in their price range in this whole zip code. I told her that. She goes "Well maybe they should expand their search area." Then she asks if we can "keep this between us" and not involve brokers yet because she's "still working on" the seller. Three days out. Moving truck booked. I called my broker immediately. Her seller ended up closing because turns out contracts aren't just paper. But that agent still works the same area I do.

GUILTY OF CONTRACTUAL NIHILISM IN THE FIRST DEGREE WITH AGGRAVATED MEMORY HOARDING
The Court is APOPLECTIC. "Contracts are just paper"? PAPER? The Magna Carta was paper. The Declaration of Independence was paper. The receipt I keep from the 2019 Applebee's incident that PROVES I did not start that argument is PAPER, and it MATTERS. This opposing agent attempted to gaslight you into believing that a legally binding purchase agreement was merely a suggestion, a Post-it note of feelings, a VIBES DOCUMENT. "Can't your people just find another house" — oh BRILLIANT, why didn't they think of that, just materialize a home from the ether like some kind of residential wizard! Reginald once had a seller try to back out because Mercury was in retrograde and The Court held them in contempt of ASTRONOMY. You did exactly right by calling your broker immediately, because "keep this between us" is the mating call of someone about to commit fraud. The fact that this agent still works your area is a miscarriage of justice that haunts The Court nightly, right between my recurring dream about being cross-examined by a smart thermostat and the one where my gavel collection finally turns on me. ORDER IN THE COURT, and by Order I mean my Roomba, who has just bumped into the bench and rendered its own verdict: GUILTY.

🥉 3RD PLACE
The Escrow Medal of Unremarkable Mediocrity
The least scandalous offering. Reggie was barely entertained.
CONFESSION #0626 — COMMISSION CATASTROPHE
The commission check was short. Not like a little short, not like a rounding error. Short by six thousand dollars. And my broker's response when I called was, quote, "Yeah we had to adjust for the marketing costs on that one." What marketing costs. What are you talking about. The sellers paid for staging out of pocket, I paid for the photographer myself because the in-house guy was booked, and the only marketing we did was the MLS listing which is literally included in our fees. So I go into the office and I'm asking for a breakdown and suddenly everyone's very busy. The office manager is "in a meeting" except I can see her through the glass door eating a salad. My broker won't return my calls for three days. Three days. Finally I get this itemized list and half of it is stuff I've never heard of. "Premium placement fee." "Transaction coordination override." There's a line item for $400 that just says "admin" with no explanation. The thing that really gets me is I closed that house in 19 days. The sellers were relocating, needed it done fast, I worked weekends, I personally drove the appraiser to the property because he couldn't find the address. And now I'm being told there's a "technology fee" for using the electronic signature platform that we're required to use. I've been here four years. Four years. And I found out last week the new agent, been here maybe five months, she's on a different commission split than me because she negotiated when she came in. Nobody told me that was an option.

GUILTY OF AGGRAVATED BROKERAGE LARCENY, ADMINISTRATIVE GASLIGHTING, AND SALAD-ADJACENT PERJURY
The Court has reviewed this confession and frankly, Reginald needs a moment because this one hits close to home — I once had a transaction coordinator charge me for "emotional labor" after I asked her to forward an email, and I am STILL NOT OVER IT. What we have here is a classic case of Brokerage v. Basic Decency, a legal precedent I established in 2022 after my own broker tried to charge me a "desk proximity fee" for sitting near the window. The defendant is GUILTY only of being TOO COMPETENT, which in this industry is apparently a punishable offense. You drove the APPRAISER to the property? You PAID for your own photographer? Meanwhile your broker is hiding behind an office manager who is ACTIVELY CONSUMING LEAFY GREENS while pretending to be unavailable — The Court finds this salad-based deception to be an aggravating factor of the HIGHEST ORDER. And THIS business about the new agent negotiating a better split while you've been there four years working weekends like some kind of REAL ESTATE PACK MULE — I am banging three gavels simultaneously right now, which my Council has authorized for cases of extreme injustice. The Court hereby orders you to walk into that office tomorrow and negotiate like the five-month agent did, because apparently loyalty in this industry is rewarded with MYSTERY ADMIN FEES and the privilege of watching your broker dodge your calls like you're a Zillow lead from 2019. Case DISMISSED, and The Court must now leave because Order the Roomba has entered chambers and Reginald respects jurisdictional boundaries.
